MINI SESSION CONTRACT

Mini Sessions will be held at 306 Abbott Street on November 19th, 2022.

The session Fee is $250. A non-refundable deposit is due at the time of booking. Please keep in mind that the time slot is not guaranteed until the deposit fee has been paid.

The fee includes a 25 min session and 10 high-resolution edited digital files.

Photos will be delivered via an online gallery.

 

Retainer and Payment: The client agrees to pay the photographer a retainer of $250 at the time of booking to secure their appointment date and time. This is a non-refundable retainer fee that goes toward your session. If there is a balance, it is due at the time of the session.

Cancellation: No refunds will be given, but you may transfer your session to another party.

Late Arrivals: Any Client that is late arriving to the session will have the amount of time late deducted from the time allotted for the session.

Re-shoots/Refunds: Re-shoots are determined at the discretion of the photographer. Re-shoots and refunds will not be given for poor choices of clothing, make-up or hair-related issues or for not following the recommendations of the photographer.

Artistic Rights: The Photographer retains the right of discretion in selecting the photographic materials released to the client.

Archive: After three (3) months, all ordered images will be purged from the photographer’s hard drive, except as needed for promotional purposes, to be determined by the photographer at the photographer’s sole discretion. The photographer is not responsible for loss or damage to the digital files due to circumstances beyond the photographer’s control. All photos not ordered will be deleted to make room.

Photographic Materials: All photographic materials, including but not limited to negatives, transparencies, proofs, and previews, shall be the exclusive property of the Photographer. Gallery proofs shall be available to the Client within 2-3 weeks of the session.

Copyright and Reproductions: The Photographer owns the copyright for all images created and shall have the exclusive right to make reproductions for, including but not limited to, marketing materials, portfolio entries, sample products, editorial submissions and use, or for display within or on the Photographer’s website and/or studio. If the Photographer desires to make other uses. The client signing this contract warrants that he or she has actual authority to agree to the use of the likeness of all persons included in the portrait in this manner and shall indemnify and defend the Photographer in the event of litigation arising out of such use. It is understood that any duplication or alteration of original images is strictly prohibited {Copyright Act (R.S.C., 1985, c. C-42)} without the Photographer's written permission.

Client’s Usage: The Client shall only use the prints, including digital files, in accordance with the permissions within this agreement. The Client’s prints are for personal use only and shall not be submitted to contests, reproduced for commercial use or authorize any reproductions by parties other than the Photographer. If the Photographer provides a digital file print release, the Client must act in accordance with the release.

Failure to Perform: If the Photographer is unable to perform this agreement due to illness, emergency, fire, casualty, strike, or causes beyond the control of the Photographer, the Photographer and Client shall make every attempt to reschedule the session. If a reschedule is unable to be agreed upon, Photographer shall return the retainer to the client and shall have no further liability. Further, if the Photographer is unable to deliver photographic materials due to technological malfunctions, including but not limited to camera and processing, or otherwise lost or damaged without fault of the Photographer, liability shall be limited.

Photographer’s Standard Price List: The charges in this agreement are based on the Photographer’s Standard Price List. This price list is adjusted periodically, and future orders shall be charged at the prices in effect at the time when the order is placed.

Model Release: I grant permission for Two Leaves Photography to take and use; printed or electronic publications, websites, or other electronic communications, media, advertising, promotion, marketing, and packaging for any products or service. I further agree that my name and identity may be revealed in text or commentary in connection with the image(s). I authorize the use of the images without compensation to me. All negatives, prints, and digital reproductions shall be the property of Two Leaves Photography. Model Release approval must be made by a parent/guardian if any photo session participants are less than 18 years of age. I agree that this release is irrevocable, worldwide and perpetual. I have read and fully understand this information in this model release. I agree this model release is for everyone involved in the session. 

Session Requests

*No cameras/camcorders/any type of recording device (this includes cell phone cameras) are allowed during the session unless a prior arrangement has been made between the client and the photographer.

*Session starts at the agreed-upon time. It is strongly encouraged that the client arrives 5-10 minutes before the start of the session. This allows for any last-minute feeding, changing, and relaxing before the session begins.

*Please make sure hair is combed and face is clean and free of runny noses or eyes.

*Please avoid eating or drinking red, orange, or heavily dyed food or drinks before the session, as these tend to leave a stain on the face.
